Agreement to Terms

Welcome to bustrackr.. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you," "user," "parent," "driver," or "school administrator") and bustrackr ("Company," "we," "us," or "our"), concerning your access to and use of the bustrackr. parent app, driver app, school admin dashboard, and bustrackr.in website (collectively, the "Platform").

By downloading, accessing, or using the Platform, you agree that you have read, understood, and are bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the Platform and you must discontinue use immediately.

We are registered in India under the Companies Act 2013 and have our registered office at NH-44, Kishora, Murthal, Sonipat, Haryana, India, 131001.

About the Service

bustrackr. provides a software-as-a-service (SaaS) solution enabling schools to manage their bus fleets and providing parents with real-time GPS tracking of their children's school journeys. We do not operate the buses, employ the drivers, or provide physical transportation services. Our role is strictly limited to providing the technology platform that connects the hardware (driver's mobile device) to the software interfaces (dashboards and parent apps).

User Accounts and Registration

To use the Platform, you must register for an account. By registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update such information to keep it accurate, current, and complete
• Maintain the security of your password and accept all risks of unauthorised access to your account and the information you provide
• Immediately notify us if you discover or otherwise suspect any security breaches related to your account or the Platform

Prohibited Activities

You may not access or use the Platform for any purpose other than that for which we make the Platform available. As a user, you agree not to:

• Systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Circumvent, disable, or otherwise interfere with security-related features of the Platform.
• Engage in unauthorised framing of or linking to the Platform.
• Use the Platform in a manner inconsistent with any applicable laws or regulations, including the Digital Personal Data Protection Act 2023.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Platform.
• Use the Platform to stalk, harass, or track individuals outside the explicit scope of authorised school transportation monitoring.
• Share access credentials with unauthorised third parties.

Hardware and Connectivity

Driver App: The driver app requires a compatible Android device with functioning GPS capabilities and an active cellular data connection. GPS accuracy depends entirely on the device hardware and network coverage. bustrackr. is not liable for tracking failures resulting from device malfunction, battery depletion, or loss of cellular signal.

Parent App: The parent app requires an iOS or Android device with an active internet connection to receive real-time updates and notifications. Push and WhatsApp notifications rely on third-party infrastructure (Apple, Google, Meta) and network providers; we do not guarantee 100% notification delivery.

Intellectual Property Rights

Unless otherwise indicated, the Platform and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Platform (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws of India and international conventions.

The Content and the Marks are provided on the Platform "AS IS" for your information and personal use only. Except as expressly provided in these Terms, no part of the Platform and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Limitation of Liability

While we strive for high accuracy in ETA predictions and live tracking, GPS drift, network latency, and physical traffic conditions create inherent variances. We are not liable for any missed pick-ups, drop-offs, or scheduling conflicts resulting from reliance on the Platform's ETAs.

Physical safety on the bus remains the sole legal responsibility of the driver, the transport contractor, and the school. bustrackr. provides monitoring tools and does not assume any duty of care regarding the physical welfare of students during transit.

Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable legal fees and expenses, made by any third party due to or arising out of:

• use of the Platform;
• breach of these Terms;
• any breach of your representations and warranties set forth in these Terms;
• your violation of the rights of a third party, including but not limited to intellectual property rights;
• any overt harmful act toward any other user of the Platform with whom you connected via the Platform.

Governing Law and Jurisdiction

These Terms shall be governed by and defined following the laws of India. bustrackr and yourself irrevocably consent that the courts of Haryana, India, shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.

Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Platform at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Platform.

We cannot guarantee the Platform will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Platform, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the Platform at any time or for any reason without notice to you.
